1. Scope and Application
These Terms and Conditions apply to all business relationships between you and Finsler Customs GmbH, Rebbergstrasse 6, 8240 Thayngen, in particular to the import and sourcing services you commission via finsler-customs.ch. We reserve the right to amend the Terms at any time; the version in force at the time of booking the service applies.
2. Notice
By using our services or our website, or by signing a contract, you agree to these Terms as well as to our Privacy Policy. You also confirm that you are of legal age and entitled to enter into legally binding contracts.
3. Legal Relationship
Every order is based on a quotation from Finsler Customs GmbH. It is valid for 7 days and is not binding on the client. The client places the order in their customer account on finsler-customs.ch: they submit the required documents, accept these Terms and the Privacy Policy and click “Place binding order”. The client may also confirm the order in writing by e-mail. A handwritten signature is not required. Finsler Customs checks the order and the documents. In both cases the contract is only concluded when Finsler Customs accepts the order, which it does with the invoice it sends to the client by e-mail. Finsler Customs is entitled to refuse orders without giving reasons. Where the vehicle is bought from a dealer and the purchase has not yet been made when the order is placed, Finsler Customs arranges the export declaration. The power of attorney for the German export required for this (export power of attorney), issued in favour of the customs agent engaged, is filled in automatically in the customer account using the dealer and vehicle details entered by the client; it is signed by the company named as exporter in the export declaration, usually the selling dealer. Clause 10 governs the ending of the order.
4. Availability and Reservation of Performance
Information about vehicle availability and delivery dates is provisional and considered approximate. We accept no liability for unavailable vehicles or delivery delays.
5. Our Obligations / Our Services
We undertake to perform the agreed services with due care and to deploy qualified staff. We act as a procurement and import service provider – the purchase contract for the vehicle is concluded exclusively between the client and the respective seller. We do not become a party to the vehicle purchase contract.
6. Duties to Cooperate / Your Obligations
You undertake to provide us in good time, completely and in suitable form with all information required for the proper performance of services. Delays or additional costs due to missing or incorrect documents are at the expense of the client.
7. Changes to Services
Change requests will be considered where possible. Changes to the vehicle purchase price, fees, taxes, transport or import costs by third parties are deemed to be a change in services and will be passed on to the client.
8. Liability
Our liability is limited to damages caused by intent or gross negligence. Liability for slight or moderate negligence is excluded. We give no warranty or guarantee regarding the condition, quality or mileage of the vehicle – such claims exist exclusively against the seller. A Quality1 warranty taken out through us is governed solely by its own warranty terms. With the Premium package, the MFK fee included in the quotation covers one inspection attempt. If the vehicle fails the roadworthiness inspection (MFK), the client bears the cost of the repairs and of the re-inspection; Finsler Customs is not liable for a failed inspection. Transport is generally at the risk of the client.
9. Remuneration, Payment Terms and Default
Remuneration is based on the quotation and is settled by invoice; prices are stated in Swiss francs including VAT. Our fee is fixed with the quotation. For the exchange rate we use the official customs exchange rate on the date of the quotation; we do not charge for exchange-rate fluctuations up to the time of payment. Exceptions are amounts in a foreign currency (usually euros) under the Basic package and the purchase price of the vehicle where we acquire it on your behalf: we settle these at the rate actually paid – in your favour as well as to your charge, and without a mark-up. What is not fixed are the duties and fees charged by the authorities, and costs incurred with third parties. If the assessment by the Swiss customs authority turns out higher than calculated, if the road traffic office charges additional fees, or if third-party costs arise – for instance rectifying defects after a failed roadworthiness inspection, an expert report, ordering a replacement COC from the manufacturer, or storage charges – we pass these on at the actual amount and without a mark-up. Third-party costs not stated in the quotation are only incurred after we have consulted you. The purchase price of the vehicle is likewise passed on where we acquire it on your behalf. The invoice is payable within 5 days of the vehicle crossing the border; Finsler Customs begins performance immediately after acceptance. Where the order includes the acquisition of the vehicle (purchase handled by Finsler Customs), the full invoice amount, including the purchase price, is payable in advance; in that case Finsler Customs only begins performance once payment has been received. In case of payment default, default interest and a reminder fee of CHF 25.00 per reminder apply.
10. Contract Duration and Termination
The contract ends with the performance of the agreed services. The client cannot end the order, except in individual cases by agreement with Finsler Customs. If the order is ended early in such a case, the work performed and the expenses incurred up to that point remain payable, in particular any payment already made to the seller. Once the vehicle has been made available, the client is obliged to take immediate delivery.
11. Data Protection
We collect and process personal data exclusively within the framework of the legal provisions. Further information can be found in our Privacy Policy, which is an integral part of these Terms.
12. Severability Clause
Should any provision of these Terms be invalid, this does not affect the validity of the remaining provisions.
13. Governing Law and Jurisdiction
Swiss substantive law applies exclusively. The place of jurisdiction is our registered office, unless mandatory statutory provisions stipulate otherwise.
